Nytro Conferences Privacy Statement

Nytro the company (Nytro Marketing Inc.), is committed to protecting your privacy and developing technology that gives you the most powerful and safe online experience. This Statement of Privacy applies to all websites within the Nytro portfolio, data secured via registrations for any and all Nytro conference and conference-related events, and governs data collection and usage that results from these sources. By using the Nytro website or one of the various websites from one of Nytro portfolio, or by attending one of Nytro conference events, you consent to the data practices described in this statement.

Collection of your Personal Information

Nytro collects personally identifiable information, including, but not limited to, your email address, name, home or work address, or telephone number. Nytro also collects anonymous demographic information, which is not unique to you, such as your ZIP code, age, gender, preferences, interests, and favorites.

In the instance of using the Nytro website or one of the various websites from one of Nytro portfolio, there is also information about your computer hardware and software that is automatically collected by Nytro. This information can include your IP address, browser type, domain names, access times and referring website addresses. This information is used by Nytro for the operation of the service, to maintain quality of the service, and to provide general statistics regarding use Nytro’s portfolio of websites.

Please keep in mind that if you directly disclose personally identifiable information or personally sensitive data through Nytro public message boards, social media accounts, or conference mobile device applications, this information may be collected and used by others. Nytro is not responsible for and disclaims any liability with respect to the privacy or security of any information you disclose through Nytro public message boards, social media accounts, or conference mobile device application.

Nytro encourages you to review the privacy statements of websites you choose to link to from Nytro’s portfolio of websites so that you can understand how those websites collect, use, and share your information. Nytro is not responsible for the privacy statements or other content on websites outside of Nytro and the Nytro family of websites.

Use of your Personal Information

Nytro collects and uses your personal information to operate the Nytro portfolio of websites and deliver the services you have requested. Nytro also uses your personally identifiable information to inform you of other products or services available from Nytro and its affiliates. Nytro may also contact you via surveys to conduct research about your opinion of current services or of potential new services that may be offered. You may opt of participation in such surveys.

Nytro does not sell, rent, or lease its customer lists to third parties. Nytro may, from time to time, contact you on behalf of external business partners about a particular offering that may be of interest to you. In those cases, your unique personally identifiable information (email, name, address, telephone number) is not transferred to the third party. In other cases, Nytro may share personally identifiable customer information (email, name, address, telephone number) with trusted partners to help us perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries. All such third parties and trusted partners are prohibited from using your personal information except to provide these services to Nytro.

Nytro does not use or disclose sensitive personal information, such as race, religion, or political affiliations, without your explicit consent.

Nytro keeps track of the websites and pages our customers visit within Nytro, in order to determine what Nytro services and events are the most popular. This data is used to deliver customized content and advertising within Nytro to customers whose behavior indicates that they are interested in a particular subject area.

Nytro websites will disclose your personal information, without notice, only if required to do so by law or Nytro reasonably believes in good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on Nytro or its portfolio of websites; (b) protect and defend the rights or property of Nytro; and, (c) act under exigent circumstances to protect the personal safety of users of Nytro, or the public.

Nytro will ask for your consent before using information for a purpose other than those that are set out in this Privacy Statement.

Cookies and Tracking

Our website uses a variety of technologies to collect information that helps us understand how our site is used. A cookie is a small file of letters and numbers that is stored on the hard drive of your computer. Cookies may expire at the end of a web session or persist in order to store your settings and preferences. A web beacon, also known as a pixel tag, is a tiny transparent image embedded in a webpage or an e-mail to measure usage and activity. In some cases, a web beacon triggers the placement of a persistent cookie on your computer.

We don’t use them to pull other data from your hard drive or to view data in cookies or other similar data files created by other websites. We will not share the information in these data files or give others access to it—except in accordance with this privacy statement. When you visit our website, we may collect, either directly or through third-party service providers, certain technical and navigational information, such as computer browser type, internet protocol (IP) address, pages visited, date and time of your visit, and average time spent on our website. This information may be used, for example, to alert you to software compatibility issues or to resolve technical or service problems. We also analyze this information, with the assistance of our service providers, to improve our web design and functionality, to enhance our ability to serve you, and to tailor our communications to you regarding our products and services.

We and our service providers may use web beacons to determine whether and when you receive and open our e-mails; these beacons may also capture information about the type of device, operating system, e-mail program, and web browser used to view the e-mail and whether you click on any links in the e-mail. This enables us to gauge the effectiveness, relevance, and value of our e-mail communications.

Security of your Personal Information

Nytro secures your personal information from unauthorized access, use, or disclosure. Nytro secures the personally identifiable information you provide on computer servers in a controlled, secure environment, protected from unauthorized access, use, or disclosure. When personal information (such as a credit card number) is transmitted to other websites, it is protected through the use of encryption, such as the Secure Socket Layer (SSL) protocol.

Changes to this Statement

Nytro will occasionally update this Statement of Privacy to reflect company and customer feedback. Nytro encourages you to periodically review this Statement to be informed of how Nytro is protecting your information.  This Privacy Statement was last updated January, 2017.

REFUND POLICY

(a) Refund Policy and Process. 

Regardless of what payment method is selected, Organizer agrees to communicate a refund policy to Attendees with respect to each event posted on the Services that meets the requirements of the Attendee Refund Policy Requirements available and to administer such policy in accordance with its terms and the Attendee Refund Policy Requirements. The Attendee Refund Policy Requirements are incorporated by reference into this Merchant Agreement. All refunds for EPP transactions must be processed through Nytro, unless otherwise agreed by Nytro. For EPP transactions, Organizer can issue refunds to Attendees directly through the Services within certain windows permitted by our Payment Processing Partners. If the refund is outside such windows, then it will need to be processed manually by Nytro. Nytro may determine in its discretion not to process any refunds which are manual, in which case they will be processed directly by Organizer. 

(b) Refund Disputes. 

Regardless of what payment method is selected, all disputes regarding refunds are between Organizer and its Attendees. In the event of a dispute, Nytro may try to mediate, but ultimately it is Organizer’s obligation to settle the dispute. Notwithstanding the foregoing, with respect to EPP transactions, Nytro shall have the right to make refunds on Organizer’s behalf as set forth in subsection (c) below. 

(c) Mandatory Refunds. 

Notwithstanding the foregoing, Organizer authorizes Nytro to make refunds in the following situations (i) Organizer specifically authorizes the refunds at the time; (ii) Nytro believes in its discretion that specific orders should be refunded under the Organizer’s posted refund policy or the Attendee Refund Policy Requirements, including without limitation, that they are required by applicable local, state, provincial, national or other law, rule or regulation or the Payment Scheme Rules; (iii) Nytro believes in its discretion that the refund request, if not granted, will lead to a chargeback that Nytro is more likely than not to lose; (iv) Organizer failed to list a refund policy on the applicable event page and Nytro believes in its discretion that a refund would be reasonable under the circumstances; (v) Nytro believes in its discretion that specific orders are fraudulent (e.g., made with stolen credit cards or otherwise not bona fide transactions); or (vi) Nytro believes in its discretion that the order is a duplicate. Organizer also authorizes Nytro to make refunds of any and all orders (including those for unrelated events) if (A) Nytro believes in its discretion that Organizer has engaged in any fraudulent activity or made any misrepresentations; (B) Nytro believes in its discretion that there is substantial risk of nonperformance by Organizer with respect to the applicable event or future events; (C) Nytro believes in its discretion that it is likely to receive complaints, refund requests, transaction reversals and/or chargebacks with respect to a substantial amount of orders; or (D) Nytro believes in its discretion that Organizer is a Prohibited Merchant, has used the Services to process Prohibited Transactions or to manage Prohibited Events or that failing to make the refunds would otherwise expose Nytro to legal liability. Because all sales are ultimately made by Organizers, Organizer hereby agrees to promptly and fully reimburse Nytro and its affiliates upon demand for refunds that Nytro makes pursuant to this Merchant Agreement, other than to the extent that the necessity for such refunds are caused by Nytro’s negligence or willful misconduct. Organizer acknowledges and agrees that chargebacks will result in losses to Nytro in excess of the amount of the underlying transaction and that by refunding transactions in advance of a chargeback Nytro is mitigating such losses and its damages with respect to Organizer’s breach of this Merchant Agreement.
